An examination is a concept that is broader than interrogation and involves only questioning witnesses, and not the actual defendant, unless he or she takes the stand as a witness at trial. The difference between an examination and a Vernehmung is that the latter is done by a German court or the German public authorities. Under the adversarial approach of common law civil procedure, the examination in a civil case is undertaken by the parties themselves.
