According to chapter XXIV of the Civil Code (Lack of conformity), an apparent defect is a defect which can be objectively observed by simple inspection. The apparent and the latent defects are not specified separately in the Civil Code. The obligor is not liable for the lack of conformity if, at the time of the conclusion of the contract, the obligee knew of the defect.
