Based on the parties' agreement, the buyer has the right to make a 'down payment' to the seller that is part of the purchase price. A down payment should be distinguished from an advance payment or earnest money. (A sum of cash deposited with the other party is construed as earnest money if provided to evidence commitment and if this intention is expressly indicated in the contract.)
