According to the Hungarian Civil Code, in the event of an unlawful arbitrary action, the possessor is entitled to bring an action requesting that the court restore the original state of possession or to order the discontinuance of restraint. The court decides which party is entitled to hold possession. In this determination, there is a presumption in favor of the party who has been disturbed in their peaceful possession.
