Comparative law notes

Hungary

According to the Hungarian Labour Code, an employer may terminate the employment relationship immediately where the employee: 1. commits a grave violation of a material obligation arising from the employment relationship 2. or otherwise behaves in a way which would make his employment relationship impossible to maintain. The right must be exercised within 15 days of becoming aware of the grounds for summary dismissal. This right cannot be exercised more than one year after the occurrence of the grounds for dismissal. In the event of a criminal offence, termination can be effected up to the limitation periods applicable to the criminal prosecution.

Definitions of summary dismissal

English

in some jurisdictions (=the area in which a particular legal system operates), the dismissal (=the end of an action before a judgment has been delivered) of an action at the very beginning, usually because it is clear that there is absolutely no justification for the action.

In March 2004, the High Court ordered summary dismissal of the claims of direct negligence against the state.

English

the immediate ending of an employee's employment because of a serious incident (usually gross misconduct)

He said that all the incidents mentioned "taken together did not justify summary dismissal".
