equitable remedy

noun

Definitions of equitable remedy

English

means of enforcing a right or compensating for loss, damage or injury developed by the old courts of equity, such as the Court of Chancery in England. These remedies are still available in common law jurisdictions, and include injunction, specific performance, recession, and estoppel.

Specific performance is an equitable remedy, and therefore something that the courts have power to exercise some discretion over.
