Comparative law notes
In a legal context, the term "enforceability" is closely related to what would be considered the most literal translation of "Wirksamkeit", namely "effectiveness". For a contractual or statutory provision to be effective, it needs to be enforceable. In some cases, provisions may be valid (i.e., not null and void), but for public policy reasons, may not be enforceable (and hence effective). Thus, the word "enforceability" can often be the best translation for "Wirksamkeit".
