overindebtedness

Comparative law notes

Germany

While the German term "Überschuldung" has fairly specific meaning under certain German laws (insolvency and inheritance laws), its English literal translation, "over-indebtedness", does not appear to be defined anywhere in US or UK law. Websters defines it as "the condition of having too much debt". There is is no uniform definition of over-indebtedness because what is considered "over" or "too much", depends on the individual circumstances.
