The term "fictitious" contains a slight connotation that the freelance status was rather intentionally fabricated. Inasmuch as companies / employers are intentionally setting up these kinds of arrangements to avoid the adverse tax and social welfare effects of employment, this phrase is perfectly adequate to use.
