Comparative law notes
The German instutiion of Referendariat is generally analogous to the institution of "law clerking" in the US and "articling" in the UK. All three institutions are in place to help young law students prepare for the practice of law. The German legal training system operates under the auspicies of the state and provides more formal training involving other areas of legal work (as a judge and public prosecutor). It also takes place after the students complete the theoretical portion of their state bar exam. Thus, the two instiutions do not match up in terms of scope and timing, but the function and the effect (to help prepare the young lawyers for the practice of law) are largely the same.
