Erbbaurecht

According to old Roman law, the ownership of a building or structure was inseparable from the ownership of the underlying land. A person with the right to use the land for that structure enjoyed a right to use the structure, bequeath it to his heirs and to encumber it, even though he did not own it directly. That right was known as a Jus Superficiarium.
