In most contexts, this word choice will suffice as an adequate translation to reflect the basic function of this institution: one of the litigants approaches another higher court to address problems that occurred in the proceedings in the first court (first instance). Only if the context suggests that the translation reader will really need to recognize that certain facts will be re-litigated in this second instance would we recommend using an awkward neologism such as "court of appeal (on points of both law and fact)"
