Add to TL entry: a review by a higher court of a decision made by a lower court that uses the trial court's records, but which does not assess or refer to the trial court's rulings on matters of law and evidence. In Australia, an appeal de novo is one in which the appeal court hears the matter afresh. Regardless of which party appeals, the appeal is conducted as an original cause and all the evidence is given anew. The judge who hears such an appeal will determine the question upon the material presented before the judge and will not be limited in any way by the decision that has been made by the body from which the appealed was made.
