Aufhebung der Ehe

Substantiv

partial

annulment of marriage

Comparative law notes

Germany

The difference here is the effect. The effect of this court order in Germany is that the marriage is voided going forward (ex nunc) from the date of the judgment. In other words, the marriage is recognized as having existed. The annulment in the Common Law realm, often used by Catholics, is to void the marriage ex tunc (i.e., from the outset). We would therefore recomment using the neologism, "annulment of marriage ex nunc"
