Some countries, such as the United States, follow the first-to-use trademark system, under which marks that are actually used in commerce first are assigned trademark rights. In Mainland China, the principle of first-to-file establishes that the right to the trademark belongs to the business whose trademark application has the earliest date of filing. The date of filing is important, not the date when the trademark was first used in commerce.
