Because in most common law jurisdictions, land title is conveyed when the deed is signed and delivered to the buyer at closing, sellers generally offer very strong warranties in the land purchase contract. Moreover, since title insurance is typically procured, there is little need to file such a preliminary notice with the public recorder of deeds. Thus, the mechanism of the Auflassungsvormerkung does not exist in Common Law countries.
