This motion is set forth in section 1,022 of the Brazilian Code of Civil Procedure, which reads: A motion for clarification may be filed in order to request the court to: I – clarify an obscurity or remove an inconsistency; II – deal with any matter or issue that the court failed to address; III – correct a material error. "Embargos de declaração" are also known as "embargos declaratórios" or simply "declaratórios".
