In Brazil, the right to refuse to give evidence against yourself in an investigation or in a trial is referred to as: "direito a não se autoincriminar" (right against self-incrimination); "direito de permanecer calado", or "direito ao silêncio" (right to remain silent). It is a constitutional right under the Brazilian Federal Constitution of 1988 (Article 5, LXIII).
