The Declaratory Action of Constitutionality (ADC, for short) was instituted by constitutional amendment 3/93 and is regulated by Law No. 9,868/99. The decision establishing the constitutionality or inconstitutionality of the law or regulation at hand must be reached by at least six out of at least eight justices. The decision is binding upon all courts and upon all federal, state and municipal governments and agencies.
