Kardinalpflicht

Substantiv

neolog

fundamental contractual duty

Comparative law notes

Austria

We recommend staying away from a literal translation such as "cardinal duty" even though "cardinal", as an adjective, does mean "of fundamental or great importance". That adjective is simply not used very often in everyday speech or legal communication. We also recommend avoiding "material duty", only because it evokes the common law concept of "material breach", which has a very specific meaning and function under the common law of contracts.
