Aufhebung der Ehe

Substantiv

partial

annulment of marriage

Comparative law notes

Austria

The difference here is the effect. The effect of this court order in Austria is that the marriage is voided going forward (ex nunc). In other words, the marriage is recognized as having existed. The annulment in the common law realm is also used to void the marriage ex tunc (i.e., from the outset). In the UK at least, annulment of marriage can be used to declare that the marriage was never legally existent ("void") or to declare it annulled going forward ("voidable"). We would recommend using the neologism, "annulment of marriage ex nunc".
